Arbitration.
My approach.
Efficient, pragmatic and fair — I focus on giving parties a full and fair opportunity to be heard, while keeping the process on track and cost-effective.
I’m well-versed in both institutional rules (such as the AAA) and ad hoc procedures, and I’m comfortable adapting to the parties’ preferences when it comes to scheduling, format, or level of formality.
I’m committed to maintaining neutrality and professionalism throughout the process, and my awards are timely and clearly reasoned.
What to expect.
Prior to the hearing, I expect counsel to have read the applicable rules and know the governing law.
As the decision-maker during the hearing, I rarely, if ever, ask substantive questions of the witnesses. The advocates, not the arbitrator, are in charge of presenting each side’s case.
Because it’s arbitration, I seldom, if ever, rule to exclude evidence or testimony. However, I will signal to counsel and parties if I am finding the testimony unhelpful because it’s duplicative or tangential.
Throughout the process, I expect the advocates to work professionally with each other and to be respectful to all involved.

We offer consulting services to lawyers who seek expert legal guidance in construction cases. We offer advice on contract review and drafting, all types of construction claims, discovery and expert deposition preparation, along with litigation support.

I bring more than 22 years of experience in handling construction, contract and commercial disputes.
Outside of the office, Tracy mentors young women and enjoys travel, boating, hiking and biking.
